ONLINE STORE REGULATIONS for ROCKWORLD Carp Fishing Store operating under the domain www.ROCKOWRLD.carpshop.com as of 01.01.2021
The following Regulations define the general sales conditions applicable in our online store available at www.rockworld-carpshop.com, operated by ROCKWORLD Łukasz Pawlik, Kochanowskiego 21, Kietrz 48-130, Poland, NIP: 7481388948, REGON: 532429748. The business is registered in the Central Registration and Information on Business (CEIDG) maintained by the Minister responsible for the economy.
1. Scope of the regulations
The regulations apply to all orders placed by Consumers and Entrepreneurs via our online store.
A Consumer, according to art. 22 of the Civil Code, is a natural person who performs a legal action with an entrepreneur not directly related to their business or professional activity.
An Entrepreneur, according to art. 43 of the Civil Code, is a natural person, legal person, and organizational unit, not a legal person, which the law grants legal capacity, conducting business or professional activity in their own name.
Other or supplementary Regulations and General Terms and Conditions used by Entrepreneurs do not apply – they will become part of the contract only if we give explicit written consent.
2. Conclusion of the contract
The sales contract is concluded with ROCKWORLD Łukasz Pawlik.
The presentation of products in our online store constitutes an offer to conclude a sales contract. To conclude a contract, selected products must be added to the shopping cart and an order must be placed. The shopping cart and entered data in the forms can be modified before placing the order using the available functionalities and messages displayed during the order placement process.
By clicking the confirm and finalize order button on the order summary page, you are placing a binding order for the products in the shopping cart. Upon receiving and registering your order in our online store's IT system, the sales contract is concluded. After placing the order, you will receive an email from us confirming the order and the conclusion of the contract.
3. Language and rules for recording the contract
The sales contract can be concluded in Polish.
We retain the content of the contract and send you an email with the order details and our Regulations. You can also check information about your orders via your customer account. The Regulations are also made available on our online store's website in a way that allows you to obtain, reproduce, and record the content.
4. Product delivery
The prices indicated for products do not include shipping costs. Ordered products are delivered via courier companies cooperating with us. Detailed information on possible delivery methods and times, as well as shipping costs, is presented during the order placement and in the special informational tab on our store's website.
The average order processing time according to data from the third quarter of 2023 is 4.5 hours, while the average delivery time by courier is 1-2 days.
It is generally possible to collect products in person at the address: ROCKWORLD Sklep dla Karpiarzy, Mikołaja 9A, 47-400 Racibórz, Poland, from 10:00 to 18:00.
Shipments to parcel machines can only be realized for products that fit in parcel machines. If there is no option to select parcel machines during order placement, the system does not allow choosing this form of delivery.
5. Payments
The following payment methods are available to you in our online store:
Electronic payments (e-payments) via the internet payment services PayU and PayNow.
The entity providing online payment services in terms of card payments is Blue Media S.A. Available forms of card payments: Visa, Visa Electron, Mastercard, MasterCard Electronic, Maestro
Cash on delivery upon receipt of the shipment.
Traditional bank transfer payment to our store's bank account. If you choose this form of payment, we will send you the payment details via email after the order is placed. Order fulfillment will start after the full amount required for the placed order is credited to our account.
Detailed information on possible payment methods, including integrated online payment services with our store and available types of e-payments and any additional costs, is presented during order placement and on our store's website in a special informational tab regarding payment methods.
In the event of a need to refund a payment, the Seller will refund the payment using the same payment method used by the Consumer, unless the Consumer explicitly agrees to a different method of return that does not incur any costs for them.
6. Right to withdraw from the contract
Consumers have a statutory right to withdraw from the contract in accordance with the information contained in the notice of the right to withdraw from the contract.
The right to withdraw from the contract also applies to natural persons concluding a contract directly related to their business activity when the content of this contract indicates that it does not have a professional character for these persons within the meaning of art. 556(4) of the Civil Code. Other entrepreneurs do not have the right to withdraw from the contract.
7. Damage during transport
For Consumers: In the case of a consumer distance purchase, our store always bears the risk of accidental damage or loss of items during transport. If the ordered products are delivered with obvious damage occurring during transport, please report such a defect to the courier and contact us as soon as possible. Delay in reporting such a complaint or contacting us does not have any consequences for your statutory claims and their satisfaction, especially for your rights under the statutory warranty for defects described in the point below. However, faster reporting helps us pursue our claims against the carrier or transport insurer.
For Entrepreneurs (excluding natural persons concluding a contract directly related to their business activity when the content of this contract indicates that it does not have a professional character within the meaning of art. 556(4) of the Civil Code): The risk of accidental loss or accidental deterioration of the product passes to you at the moment it is handed over to the forwarder, carrier, or another person or institution responsible for shipping. We are not liable for loss, damage, or deterioration of the product occurring from the moment it is accepted for transport until it is delivered to you and for delays in delivery caused by the carrier.
8. Warranty, guarantees, and seller liability
For Consumers: We are obliged to deliver products (items) free from defects. The statutory right to product liability for defects (so-called warranty for defects) applies as specified in art. 556 and subsequent articles of the Civil Code. We are liable under the warranty if a physical defect is found within two years from the date of delivery of the item to you. If the item sold is a used movable item, liability under the warranty lasts one year from the date of its delivery.

We commit to responding to complaints immediately, but no later than within 14 days from the date of submission. In the case of executing rights under the warranty – if we deem it necessary to consider the complaint, you are required, at our cost, to deliver the defective item to the postal address indicated above. If due to the nature of the item or its installation, its delivery would be excessively difficult, you are required to make the item available to us at the location where it is located.
Information regarding any additional warranty and its detailed terms are always included with the product and available on the online store's information pages.
For Entrepreneurs: In the case of a sales contract concluded with an Entrepreneur, based on art. 558 § 1 of the Civil Code, the liability of our online store under the warranty for defects of the item is excluded.

9. Services provided electronically
To use our online store, including browsing the assortment and placing orders, it is necessary to have a multimedia device with an installed web browser and access to the Internet and email. It is recommended to enable JavaScript scripts and Cookies in the browser settings. Users are required to use the online store in a manner consistent with the law and good manners, and it is prohibited to provide unlawful content.
We undertake all necessary actions to ensure the fully correct operation of the service and interface of our online store to the extent that results from current technical knowledge and commit to removing any reported malfunctions and technical problems within a reasonable time. This also applies to the possibility of subscribing to the newsletter or optionally creating a customer account – if these services are provided within our store. You can notify us of any detected irregularities or interruptions in the operation of the service and services of our online store via the contact details indicated above. In a complaint regarding irregularities related to the technical functioning of the online store service, please indicate the type and date of occurrence of the irregularity.

11. Alternative dispute resolution
We inform that Consumers have the possibility to use alternative dispute resolution methods for complaints and claims. Information on how to access the aforementioned mode and procedures for resolving disputes is available at the following address: www.uokik.gov.pl in the "Consumer dispute resolution" section.
Additionally, at the address: ec.europa.eu/consumers/odr, Consumers have access to the online consumer dispute resolution platform (so-called ODR platform). The ODR platform is a multilingual, interactive website for servicing Consumers and entrepreneurs seeking out-of-court resolution of disputes arising from distance sales contracts or service contracts.
Using the aforementioned alternative methods of pursuing claims and resolving disputes is voluntary and can only occur if both parties to the dispute (Consumer and seller) consent to it.
12. Final provisions
None of the provisions of these Regulations is intended to violate the statutory rights of the Consumer. In the event of any discrepancies between the provisions of these Regulations and the rights of Consumers resulting from generally applicable laws – statutory regulations will always apply in place of the contested provisions of the Regulations.
If you are an Entrepreneur, then Polish law applies to all contracts concluded with us, excluding the United Nations Convention on Contracts for the International Sale of Goods.
If you are an Entrepreneur, a legal person under public law, or a separate public-law entity, the court exclusively competent to resolve all disputes arising from contractual relations between us and you will be the court competent for our registered office. The previous sentence does not apply to natural persons concluding a contract directly related to their business activity when the content of this contract indicates that it does not have a professional character for these persons within the meaning of art. 556(4) of the Civil Code.
